TERMS & CONDITIONS

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and WebStuff LLC, a Florida limited liability company (“WebStuff,” “we,” “us,” or “our”), governing your access to and use of the voiceactor.com website, platform, services, tools, and any associated applications (collectively, the “Service”).
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using the Service, you agree to comply with and be legally bound by these Terms, as well as any additional guidelines, policies, or rules referenced herein or posted on voiceactor.com.

2. ELIGIBILITY

The Service is intended solely for individuals who are 18 years of age or older.
By using the Service, you represent and warrant that:

  • You are at least 18 years old, and
  • You have the legal capacity and authority to enter into these Terms.


3. ACCOUNT REGISTRATION

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, complete, and current information
  • Maintain the confidentiality of your login credentials
  • Be solely responsible for all activities conducted under your account

WebStuff reserves the right to suspend or terminate any account that violates these Terms or provides false or misleading information.

4. SUBSCRIPTION PLANS AND BILLING

4.1 Plans

The Service offers both:

  • Free access with limited functionality (“Free Plan”), and
  • Paid subscription plans (“Paid Plans”).

4.2 Billing & Auto-Renewal

Paid Plans are billed on a monthly or annual recurring basis, depending on the User’s selection.

Unless canceled prior to the end of the billing period:

  • Subscriptions automatically renew, and
  • The User authorizes WebStuff and its payment processors (Stripe, PayPal) to charge the applicable fees.

4.3 Refund Policy

WebStuff generally does not provide refunds.
However, WebStuff may, at its sole discretion, issue a refund under exceptional circumstances.

4.4 Taxes

Fees are exclusive of taxes. Users are responsible for any applicable taxes, except those based on WebStuff’s income.

5. FREE PLAN

The Free Plan is offered “as-is” with no guarantee of availability, uptime, or support.
WebStuff may modify, restrict, or discontinue the Free Plan at any time without notice.

6. USER CONTENT

6.1 Definition

User Content” means any text, images, media, code, data, or materials uploaded, created, or published by Users on or through the Service.

6.2 License to WebStuff

By submitting or creating User Content, you grant WebStuff a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Host
  • Store
  • Display
  • Publish
  • Transmit
  • Reproduce
  • Modify
  • Process
  • Distribute

    such content solely for the purpose of operating, maintaining, supporting, and improving the Service.

6.3 User Responsibilities

Users represent and warrant that:

  • They own or have the right to use all User Content
  • The content does not infringe any third-party rights
  • The content complies with all applicable laws and these Terms

6.4 Prohibited Content

Users may not upload, publish, or host:

  • Adult or pornographic content
  • Copyrighted materials without proper authorization
  • Harmful, illegal, defamatory, fraudulent, or misleading content
  • Malicious code, viruses, or scripts

WebStuff may remove any User Content at its discretion.

7. PROHIBITED CONDUCT

Users agree not to:

  • Use the Service for unlawful purposes
  • Interfere with or attempt to circumvent security measures
  • Copy, modify, or reverse engineer the Service
  • Use automated tools (scrapers, robots, crawlers) without permission
  • Engage in activities that degrade, overload, or impair the Service

WebStuff reserves the right to investigate and take action, including legal action, for violations.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Ownership

All rights, title, and interest in the Service—including but not limited to:

  • Templates
  • Themes
  • Code
  • Software
  • Tools
  • Logos
  • Trademarks
  • User interface elements

—are the exclusive property of WebStuff LLC or its licensors.

8.2 Limited License to Users

Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the purpose of creating and managing their websites.

Users may not:

  • Copy or redistribute platform code
  • Use templates outside of the Service
  • Claim ownership of WebStuff’s intellectual property


9. THIRD-PARTY SERVICES

Use of third-party integrations, domains, payment gateways, or other services is subject to the respective third-party terms.
WebStuff is not responsible for third-party actions or failures.

10. TERMINATION & CANCELLATION

10.1 By User

Users may cancel their accounts at any time. Upon cancellation:

  • Access terminates immediately
  • All User Content and data are permanently deleted
  • Data deletion is irreversible

10.2 By WebStuff

WebStuff may suspend or terminate an account at any time for:

  • Violating the Terms
  • Illegal or harmful activities
  • Failure to pay fees
  • Creating prohibited content

WebStuff is not liable for any resulting loss of data.

11. DISCLAIMERS

11.1 “As-Is” Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
WebStuff expressly disclaims all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability or uptime guarantees

11.2 No Guarantee of Results

WebStuff does not guarantee:

  • Traffic, revenue, or business outcomes
  • That the Service will be error-free or uninterrupted


12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, WebStuff shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits or revenues
  • Loss of data
  • Downtime or business interruption
  • Unauthorized access to accounts

In all cases, WebStuff’s total liability shall not exceed the amount the User paid in the preceding six (6) months, or $50, whichever is greater.

Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted by law.

13. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless WebStuff LLC and its affiliates, officers, employees, and contractors from any claims, liabilities, damages, losses, and expenses arising from:

  • User Content
  • Use or misuse of the Service
  • Violation of these Terms
  • Violation of any applicable law


14. DISPUTE RESOLUTION & ARBITRATION

14.1 Binding Arbitration

All disputes shall be resolved through binding arbitration, administered by the American Arbitration Association (AAA), located in Seminole County, Florida.

14.2 Class Action Waiver

Users agree that:

  • Arbitration shall be conducted on an individual basis
  • No class actions, representative actions, or class arbitrations are permitted

14.3 Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

All notices must be sent in writing to:

Notices sent electronically via the platform may also be considered valid where permitted.

16. PRIVACY POLICY

Use of the Service is also governed by our Privacy Policy, which is incorporated by reference.
The Privacy Policy is maintained as a separate document and may be updated independently.

17. MISCELLANEOUS

17.1 Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is deemed invalid, the remaining provisions remain in full force.

17.3 Waiver

Failure to enforce any right or provision shall not constitute a waiver of such right or provision.

17.4 Assignment

Users may not assign their rights under these Terms. WebStuff may assign these Terms in connection with a merger, acquisition, or sale of assets.
